Terms of Service

Effective date: [Insert effective date]
Website operator: [Insert legal name of individual or entity]

These Terms of Service govern your use of nyfera.org (“NYFERA,” “we,” “us,” or “our”), including its articles, school profiles, data resources, downloads, and tools. If you do not agree to these Terms, please discontinue use of the website.

NYFERA provides independent reference information. Our content concerns New York education, schools, public data, funding, and accountability. NYFERA is not an official school, government agency, admissions service, or charter authorizer.

Information on the website does not constitute individualized educational, legal, financial, or other professional advice. Confirm important requirements, deadlines, services, and institutional details directly with the responsible school, district, or agency.

Our Disclaimer explains additional limitations affecting the use of our information.

You may use the website for lawful purposes. You must not:

  • Attempt to gain unauthorized access to systems, accounts, or nonpublic information.
  • Introduce malware, interfere with website security, or disrupt availability.
  • Use automated requests in a manner that causes unreasonable load or bypasses access restrictions.
  • Submit fraudulent, threatening, unlawful, or knowingly misleading material.
  • Impersonate NYFERA, its contributors, schools, or public agencies.
  • Attempt to identify students from suppressed or aggregate data.

Nothing in these Terms prohibits lawful criticism, reporting errors, or exercising rights protected by applicable law.

Intellectual property rights depend on the material concerned. NYFERA’s original text, designs, and graphics are protected to the extent provided by law. Third-party photographs, logos, documents, datasets, and other materials remain subject to their respective rights and licenses.

You may access, link to, and make reasonable personal or classroom use of NYFERA’s original content, provided you preserve relevant attribution and do not misrepresent its source or meaning. This permission does not extend to material for which NYFERA cannot grant reuse rights.

Permission is required for reproducing or republishing substantial portions of protected original content unless an applicable license or legal exception permits the use. Copyright exceptions, including fair use where applicable, remain available; these Terms do not replace the legal assessment required for a particular use.

NYFERA does not claim exclusive ownership of public-domain information or underlying facts. Openly licensed materials remain governed by their applicable licenses. Consult image credits and source-specific notices before reuse.

Data and tool outputs require careful interpretation. Figures may refer to different reporting periods and may be revised by their original publishers. Calculators and comparisons depend on their inputs, definitions, assumptions, and processing methods.

Review the accompanying source notes and Data Methodology before relying on results. Do not present NYFERA’s calculations as official agency determinations or remove limitations in a way that makes an output misleading.

You remain responsible for material you submit. If you send a correction, suggestion, document, or other contribution, you must have the right to provide it and must not knowingly misrepresent its contents.

Submitting material gives NYFERA permission to receive, examine, and use it as reasonably necessary to assess and respond to your request. It does not transfer ownership or automatically authorize publication of private correspondence. Any additional publication permission must be obtained where required.

Do not submit confidential student records, identification numbers, medical information, passwords, or other sensitive personal material. A message to NYFERA is not a formal submission to a school, district, regulator, or appeals body.

Privacy practices are explained separately. Our Privacy Policy should be consulted for information about the collection, use, retention, and sharing of personal information. These Terms do not, by themselves, constitute consent to optional tracking, marketing, or unrelated data uses.

External services operate under their own terms. Links may direct you to school websites, government resources, research publications, or other third-party services. NYFERA does not control their content, security, accessibility, or availability. A link does not imply endorsement.

Website availability and accuracy cannot be guaranteed. To the extent permitted by applicable law, the website and its resources are provided “as is” and “as available,” without warranties of uninterrupted operation, completeness, or suitability for a particular purpose.

These limitations do not remove our responsibility to address substantiated publication errors under our Corrections Policy.

To the extent permitted by law, NYFERA is not liable for indirect or consequential losses arising from use of, or inability to use, the website. Nothing in these Terms excludes or limits liability or rights that cannot lawfully be excluded or limited.

Access may be restricted to protect the service. We may take proportionate action against misuse, security threats, or violations of these Terms. We may also modify or discontinue resources. Any separately agreed contractual obligations remain subject to their own terms.

Changes to these Terms should be published with a revised effective date. Material changes should receive appropriate notice and apply prospectively, subject to applicable law and any required agreement.

If a provision is unenforceable, the remaining provisions continue to apply to the extent legally permissible. These Terms do not waive mandatory consumer protections or other nonwaivable rights.

Questions about these Terms, permissions, or website use may be submitted through our Contact Us page.
